Terms of Use

These Terms of Use (“Terms”) govern your use of the Consulta iOS app, operated by Elbert Education LLC (“Consulta,” “we,” “us”). Please read them carefully.

1. Acceptance of these terms

By downloading, accessing, or using Consulta, you agree to these Terms. If you do not agree, do not use the app.

2. What Consulta is

Consulta is an educational tool that teaches medical Spanish and lets you practice with AI-generated simulated patients. Consulta is not medical advice, is not a medical interpreter or interpretation service, and is not a substitute for professional clinical judgment or for a qualified interpreter when one is required for patient care. You are responsible for following the laws, regulations, and policies that apply to your practice, including when a qualified interpreter must be used.

3. Eligibility

You must be at least 18 years old to use Consulta.

4. Accounts

Core learning features do not require an account. Signing in with Apple is optional and is used only to provide access to paid features and to redeem access codes. You are responsible for activity that occurs through your device and your Apple account.

5. Subscriptions and billing

Consulta offers a free tier and an optional paid subscription, “Consulta Pro.” Paid subscriptions are sold and billed through the App Store by Apple. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your Apple Account settings; deleting the app does not cancel a subscription. Payment, refunds, and billing are handled by Apple under Apple’s terms, including Apple’s standard Licensed Application End User License Agreement and Apple’s refund policy. Any pricing and plan details are shown in the app before you purchase.

6. Acceptable use

You agree not to:

  • enter real patient information or other protected health information into the app;
  • use Consulta for actual patient care, diagnosis, or treatment decisions;
  • copy, resell, reverse-engineer, or redistribute the app or its content; or
  • interfere with, overload, or attempt to gain unauthorized access to the service.

7. Intellectual property

The app, its lessons, audio, designs, and other content are owned by Elbert Education LLC and are protected by intellectual-property laws. The “Consulta” name and brand are ours. We grant you a personal, non-transferable, non-exclusive license to use the app for your own professional learning, subject to these Terms and to Apple’s Licensed Application End User License Agreement.

8. AI-generated content

Simulated patients, their replies, and the feedback you receive are generated by artificial intelligence. AI output can be inaccurate, incomplete, or inappropriate, and it does not represent the views of Consulta. It is provided for language practice only and is not clinical guidance. Always apply your own professional judgment.

9. Disclaimers

Consulta is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that its content (including AI-generated content and translations) is accurate or complete.

10. Limitation of liability

To the fullest extent permitted by law, Elbert Education LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or reliance on, the app or its content — including any clinical, patient-care, or professional outcome. Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the claim.

11. Indemnification

You agree to indemnify and hold harmless Elbert Education LLC from claims, damages, and expenses arising out of your use of the app or your violation of these Terms.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

13. Changes to these terms

We may update these Terms as the app evolves. When we make material changes, we will update the “Last updated” date above. Your continued use of the app after changes take effect means you accept the updated Terms.
